Article 2 – Subject This agreement covers the rights and obligations of the parties related to the sale, payment, and delivery of the products ordered by the BUYER from the website www.casanovius.com owned by the SELLER. The contract is drawn up in accordance with the Consumer Protection Law and the Regulation on Distance Contracts.

Article 3 – Product and Payment Information The type, quantity, payment method, delivery details, and product price of the ordered items are specified in the buyer’s order form and constitute an integral part of this agreement.

Article 4 – Delivery and Shipping The ordered products are shipped within 4–7 business days after payment is confirmed. Delivery times may vary during campaigns, special occasions, or high order volumes. The tracking number will be shared with the buyer once the order is shipped.

The buyer must inspect the package before accepting it from the courier. Damaged or opened packages should not be accepted and a report should be filed with the courier. Otherwise, the seller cannot be held responsible for any damages to the accepted package.

Article 5 – Seller’s Rights and Obligations

5.1. The seller undertakes to deliver the products in accordance with the applicable laws and regulations.

5.2. Casa Novius is not responsible for any issues arising from system errors, pricing inaccuracies, or unauthorized access to the website. The BUYER cannot claim any rights or compensation due to such situations.

Article 6 – Buyer’s Rights and Obligations The buyer agrees to pay the price of the ordered product and to accept the delivery. The buyer declares that they have read and accepted the right of withdrawal, return conditions, and delivery details.

Article 7 – Nature and Use of Handmade Jewelry and Natural Stone Products

7.1. The jewelry and natural stone products sold by Casa Novius are handmade using natural stones. Therefore, slight variations in color, texture, shape, or pattern may occur, which are considered a part of the product's uniqueness and natural origin.

7.2. The buyer agrees to avoid contact with perfume, water, chlorine, lotion, and other chemicals to ensure the longevity of the products, and to use them with care.

7.3. Due to the nature of natural stones, there is a risk of scratching or breakage. The buyer acknowledges this and agrees to handle the products with utmost care.

7.4. These care instructions have been previously provided to the buyer, and the buyer accepts these conditions by placing an order.

Article 8 – Right of Withdrawal and Return Conditions The buyer may exercise the right of withdrawal within 14 days from the delivery date. Returned products must be sent back in their original packaging and complete. The right of withdrawal cannot be used for personalized or custom-made products. Return shipping costs are borne by the buyer.

Article 9 – Privacy and Data Protection Casa Novius uses the buyer's personal data solely for order and delivery purposes in accordance with the Personal Data Protection Law (KVKK) and does not share them with third parties.

Article 10 – Dispute Resolution In case of disputes, the laws of the Republic of Turkey apply. Within the monetary limits set by the Turkish Ministry of Trade, Consumer Arbitration Committees and Consumer Courts are authorized.

Article 11 – Enforcement By placing an order via www.casanovius.com, the buyer declares that they have read, accepted, and approved all the terms of this agreement.
